Kurdolphin Copyright Infringement & DMCA Policy

1. Commitment to Intellectual Property

Kurdolphin ("we," "us," or "our") is committed to respecting the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the WIPO Copyright Treaty, and the intellectual property laws of the Republic of Iraq and the Kurdistan Regional Government (KRG), we will respond expeditiously to claims of copyright infringement committed using the Kurdolphin platform.

2. Safe Harbor & Platform Role

Kurdolphin operates as a hub for anime, manga, news, e-commerce, and community discussion. We may host user-generated content, third-party links, or community discussions. Kurdolphin does not actively monitor all user-generated content for potential infringement. Our legal protection relies on a "Notice and Takedown" procedure. If you believe your copyrighted work has been copied and is accessible on Kurdolphin in a way that constitutes copyright infringement, please follow the procedure below.

3. Notice of Claimed Infringement (Takedown Notice)

To ensure your claim is processed swiftly and to protect Kurdolphin under Safe Harbor provisions, your DMCA Takedown Notice must contain all of the following information. Incomplete notices may be delayed or rejected at our sole discretion:

• Identification of the Copyrighted Work: A clear description of the copyrighted work you claim is being infringed (e.g., title, author, registration number if applicable). If multiple works are covered by a single notification, a representative list of such works.
• Identification of the Infringing Material: The exact URL(s) on the Kurdolphin platform where the allegedly infringing material is located. General statements like "your site has my anime" will not be accepted.
• Your Contact Information: Your full legal name, physical address, telephone number, and a valid email address.
• Statement of Good Faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner.
• Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Our Response to Valid Notices

Upon receipt of a complete and valid DMCA Takedown Notice, Kurdolphin will:

• Promptly remove or disable access to the allegedly infringing material.
• Notify the user who posted the material that it has been removed or disabled.
• Maintain a record of the takedown for our internal compliance logs.

5. Counter-Notice Procedure (User Appeal)

If you believe your content was removed or disabled by mistake or misidentification, you have the right to file a Counter-Notice. Your Counter-Notice must include:

• Your physical or electronic signature.
• Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the competent courts in the Republic of Iraq / Kurdistan Region, and that you will accept service of process from the person who provided the original takedown notice.

Upon receiving a valid Counter-Notice, we may restore the material within 10 to 14 business days, unless the original claimant notifies us that they have filed a legal action seeking a court order to restrain the user from engaging in infringing activity.

6. Repeat Infringer Policy

In accordance with the DMCA and local intellectual property laws, Kurdolphin has a strict policy of terminating the accounts of users who are determined to be repeat infringers. If you are a Kurdolphin user and you believe another user is a repeat infringer, please include "Repeat Infringer" in the subject line of your email to our Designated Agent, along with evidence of previous infringements by that user.

7. Misuse of the DMCA Process

Please be aware that under 17 U.S.C. § 512(f) and relevant Iraqi civil law, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including court costs and attorney's fees. Kurdolphin reserves the right to seek legal remedies against parties who submit fraudulent or abusive takedown notices.
